Terms of Use and Sale
1. About us and these terms
https://southfacing.in is operated by South Facing Solutions, a sole proprietorship owned by Akhilkumar Rajendrakumar Pandya, B-37, K Vihar, Near ITI Crossing, Uttarsanda, Nadiad, Gujarat 387370, India ("we", "us").
These Terms apply to your use of the website and to purchases made through it. By using the website or placing an order, you agree to these Terms and to the following documents:
- the TrueSouth License Agreement, which governs use of the software;
- our Privacy Policy;
- our Refund Policy;
- our Delivery Policy.
2. Who can buy
You must be at least 18 years old and able to enter into a binding contract. Our products are professional tools, intended for business and professional use.
At present we accept payments in Indian Rupees through our payment partner.
3. Products and prices
We sell software licenses, delivered digitally. The product page describes what each license includes: the major version, the number of computers, and the system requirements. Please check the requirements before buying.
Prices are shown in Indian Rupees at checkout. We are not currently registered under GST, so no GST is charged on our prices and our invoices do not carry GST. If we register in future, prices shown at checkout will say whether GST is included.
Price changes do not affect orders already paid. If a product is shown at an obviously wrong price because of an error, we may cancel the order and refund you in full.
4. Ordering and payment
Your order is complete when our payment partner, Razorpay, confirms your payment. You pay on Razorpay's secure checkout (UPI, cards, net banking and other methods it offers). We do not see or store your card or bank details, and Razorpay's terms also apply to the payment.
We may refuse or cancel an order that we reasonably suspect is fraudulent or unauthorised. If we do, we refund any amount paid.
You receive an invoice by email and on your purchase page. As we are not registered under GST, the invoice does not allow an input tax credit.
5. Delivery
License keys are delivered electronically, usually within minutes of payment confirmation. Our Delivery Policy has the details.
6. Refunds and cancellation
You can get a full refund within 7 days of purchase if your license key has not been activated, plus in the other cases listed in our Refund Policy. Because orders are delivered instantly, cancelling an order is handled as a refund request under that policy.
7. Your purchase links and key
Your purchase email and purchase page contain your license key and private download link. Keep them confidential. We are not responsible for misuse that results from sharing them, but contact us if a key is exposed and we will help.
8. Using the website
You must not do any of the following:
- misuse the website or the license service;
- attempt unauthorised access, or probe, scan or overload our systems;
- use automated means to create orders or activations;
- copy the website's content for commercial purposes without our permission.
The website content, the TrueSouth and South Facing Solutions names, and our logos are our property.
9. Information on the website
We try to keep the website accurate and up to date. Articles, examples and sample reports are general information, not professional advice for your project.
Results produced with our software are feasibility estimates, as explained in the License Agreement.
10. Liability
To the extent permitted by law:
- the website is provided "as is";
- we are not liable for indirect or consequential loss arising from its use;
- our total liability for any order is limited to the amount paid for that order.
Liability for our software is governed by the License Agreement. Nothing in these Terms limits rights you have under the Consumer Protection Act, 2019, that cannot be excluded.
11. Events beyond our control
We are not responsible for delays or failures caused by events beyond our reasonable control. These include outages of payment, hosting, email or internet services, natural events and government action.
12. Law, disputes and grievances
These Terms are governed by the laws of India. The courts at Nadiad, Gujarat have exclusive jurisdiction, without affecting your right to approach a consumer commission.
Before starting a formal dispute, please contact our Grievance Officer: Akhilkumar Rajendrakumar Pandya, Proprietor, support@southfacing.in, +91 63550 90650. We acknowledge complaints within 48 hours and aim to resolve them within one month.
13. Changes
We may update these Terms. The version published at the time of your order applies to that order.
